SECRETARY BALDOZ DENIES PAL’S MOTION FOR RECONSIDERATION ON THE DOLE’S ORDER FOR THE ISSUANCE OF A WRIT OF EXECTUTION TO REINSTATE MEMBERS WHO WERE RETIRED BEFORE 60 YEARS OLD
FASAP is asking for a Writ of Execution to compel PAL to reinstate FASAP members who were compulsorily retired before sixty (60) years old during the CBA period from July 16, 2007 to July 15, 2010. PAL refused to reinstate the retired flight attendants after it maintained that the DOLE Orders last 23 December 2010 and April 01, 2011 should be applied only to FASAP members who were active at the time and not retroactively. “The issue of reinstatement and payment of adjusted back salaries and benefits are logical, natural and inevitable consequence of the ruling that the retirement age shall be set at 60 starting 16 July 2007.” Secretary Baldoz stated. She further wrote resolved that, “To us, a categorical statement on the reinstatement of those who were retired at ages 45 and 55 starting 16 July 2007 onwards is imperative if we were to give life to the Decision which covered also the same period of application with regard to the other benefits awarded therein. The necessary consequence also is payment of the adjusted back salaries and incidental benefits as clearly stated in the assailed Order.” Secretary Baldoz finally Ordered, “WHEREFORE, premises considered, the Motion for Reconsideration filed by respondent Philippine Airlines, Inc. praying that the Order date 12 March 2012 by this Office be annulled and set aside, is DENIED. The 12 March 2012 Order granting the issuance of Writ of Execution STANDS. Let a Writ be issued enforcing the 23 December 2010 Decision as modified by the 01 April 2011 Order. SO ORDERED.” FASAP President Bob Anduiza immediately thanked Secretary Baldoz saying, “We are very happy with your resolution. Thank you very much! We are now building up good relations with the SMC-led PAL management and hopefully we can work with them towards addressing our concerns for a clean slate. Thank you once again for upholding FASAP members’ rights!”
May 6, 2013 PAL FLIGHT ATTENDANTS’ UNION BACKS AKBAYAN We, the officers and leaders, in the Flight Attendants’ and Stewards’Association of the Philippines (FASAP) fully endorse the AKBAYAN party-list in the coming elections. AKBAYAN was with us in our fight against age and gender discrimination in the work place, which helped us win a historic ruling before the Department of Labor and Employment in December, 2010. The FASAP members’ retirement age was raised to 60 years old for both male and female flight attendants. For us, among the many party-list groups in Congress, AKBAYAN stands out as a real peoples’ representative who cares, works and fights for the welfare of the workers, peasants, farmers and other marginalized sectors in the country. AKBAYAN is an organization composed of top-notch intellectuals and advocates who stand on principle and decency led by Rep. Walden Bello, whose contribution to Philippine Society cannot be measured.A true activist who seeks change for the betterment of the people, Rep.Bello,is a recognized icon in the progressive movement. For workers, AKBAYAN, is pushing for the enactment of the Security of Tenure Bill,to benefit the millions of exploited contractual employees who have to endure the vicious cycle of working for 5 months and ending their contract, only tore-apply again for another short stint as contractuals. This is prevalent in many commercial establishments where most workers do not enjoy regular employment and are constantly oppressed even by the richest businesses in the country. In our democracy, our hope lies in choosing very carefully the leaders who will truly take care of our needs and who will enact laws that will benefit the people. We need representatives in Congress who will not steal the tax payers’ money and who are known persons with integrity and decency.
